These Terms & Conditions ("Terms") govern your access to and use of the website located at this domain (the "Site"), operated by LG Roofing Materials ("LG Roofing Materials," "LG," "we," "us," or "our"), a roofing materials dealer based in Houston, Texas. By accessing or using the Site, you agree to be bound by these Terms in full. If you do not agree to these Terms, you must not access or use the Site. These Terms apply to all visitors, users, and others who access the Site.
LG Roofing Materials is an independent reseller and distributor of roofing materials. We sell, distribute, and/or facilitate the pickup and delivery of products manufactured by third-party companies, including but not limited to Owens Corning, GAF, CertainTeed, Atlas Roofing, IKO, and TAMKO (each a "Manufacturer," collectively the "Manufacturers").
Unless explicitly and expressly stated otherwise in writing, LG Roofing Materials is not owned by, operated by, affiliated with, sponsored by, partnered with, or officially endorsed by any Manufacturer named or referenced on this Site, including Owens Corning. Any reference to a Manufacturer, its product lines (including "Oakridge®"), or its programs (including the "Total Protection Roofing System®") is made strictly to identify and describe products that LG Roofing Materials offers for sale, and does not imply any business relationship, partnership, joint venture, agency, sponsorship, certification, or endorsement between LG Roofing Materials and that Manufacturer beyond LG Roofing Materials' status (where applicable) as an authorized seller of that Manufacturer's products.
All trademarks, service marks, trade names, logos, product names, brand names, color names, product photography, descriptive text, and other intellectual property displayed on this Site that reference a Manufacturer (including, without limitation, "Owens Corning®," "Oakridge®," "SureNail®," "StreakGuard®," "Total Protection Roofing System®," the Owens Corning logo, and any associated character or mascot imagery) are the sole and exclusive property of their respective owners, including Owens Corning Corporation and its affiliates.
LG Roofing Materials claims no ownership, right, title, or interest in any Manufacturer's trademarks, copyrighted material, product imagery, or other intellectual property. Such material is used on this Site solely for nominative, descriptive, and informational purposes — that is, to identify and describe genuine products that LG Roofing Materials sells — in reliance on the nominative fair use doctrine recognized under U.S. trademark law, under which use of another's mark is permitted where: (a) the product or service referenced cannot be readily identified without using the Manufacturer's mark or name; (b) only so much of the mark is used as is reasonably necessary to identify that product or service; and (c) nothing about the use suggests sponsorship, endorsement, or approval by the Manufacturer beyond LG Roofing Materials' role (where applicable) as a seller of genuine, authentic products. No license, assignment, or transfer of any intellectual property right is granted or implied to any visitor of this Site.

Subject to your compliance with these Terms, LG Roofing Materials grants you a limited, non-exclusive, non-transferable, revocable license to access and view the Site and the LG Content on a personal device, for your own personal, non-commercial use in evaluating LG Roofing Materials' products and services. This license does not include any right to: (a) resell, sublicense, or make any commercial use of the Site or LG Content; (b) collect or use any product listings, descriptions, or pricing for the benefit of a competing business; (c) reproduce, duplicate, copy, frame, or mirror any portion of the Site; or (d) use any data mining, robots, scraping, or similar automated data-gathering tools on the Site without our prior written permission. THIS SECTION DOES NOT LIMIT LIABILITY FOR ANY SEPARATE, SIGNED PURCHASE AGREEMENT OR INVOICE BETWEEN YOU AND LG ROOFING MATERIALS FOR THE ACTUAL SALE OF PHYSICAL PRODUCTS, WHICH IS GOVERNED BY ITS OWN TERMS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
You agree to defend, indemnify, and hold harmless LG Roofing Materials and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the Site; (b) your violation of these Terms; or (c) your violation of any third-party right, including any intellectual property or trademark right of a Manufacturer.
LG Roofing Materials respects the intellectual property rights of others and expects visitors to do the same. If you are a copyright or trademark owner, or an authorized representative of one, and believe that material on this Site infringes your rights beyond the limited, nominative, informational use described in Section 3, please send a written notice to our contact in Section 18 that includes, to the extent applicable:
Upon receipt of a complete and valid notice, LG Roofing Materials will promptly review the claim and, where appropriate, remove or disable access to the identified material. We may also remove material proactively, without prior notice, in our sole discretion. A party who submits a knowingly false or bad-faith claim under this Section may be liable for damages, including costs and attorneys' fees, incurred by LG Roofing Materials as a result.
These Terms remain in effect while you use the Site. We reserve the right, in our sole discretion and without notice or liability, to: (a) modify, suspend, or discontinue all or any part of the Site at any time; (b) restrict, suspend, or terminate your access to the Site, in whole or in part, for any reason, including a suspected violation of these Terms; and (c) remove or modify any content on the Site at any time. Sections of these Terms that by their nature should survive termination (including Sections 3, 6–12, and 14–16) will survive any termination of your access to the Site.
Please read this section carefully — it affects your legal rights and requires arbitration of most disputes on an individual basis rather than as a plaintiff or class member in any purported class, consolidated, or representative action.
14.1 Informal Resolution First. Before filing a claim, you agree to first contact us at the address in Section 18 and attempt in good faith to resolve any dispute informally for at least thirty (30) days.
14.2 Binding Arbitration. If a dispute is not resolved informally, you and LG Roofing Materials agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be resolved by binding arbitration administered under the rules of a recognized arbitration provider (such as the American Arbitration Association), rather than in court, except that either party may bring an individual action in small claims court for disputes within that court's jurisdiction.
14.3 Class Action & Jury Trial Waiver. YOU AND LG ROOFING MATERIALS EACH WAIVE ANY RIGHT TO A JURY TRIAL AND AGREE THAT ANY ARBITRATION OR PERMITTED COURT PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
14.4 Right to Opt Out. You may opt out of this arbitration agreement by sending written notice to the address in Section 18 within thirty (30) days of first accessing the Site. If you opt out, neither you nor LG Roofing Materials is required to arbitrate disputes between you, and Section 15 governs venue instead.
These Terms and any dispute arising out of or related to the Site (including any dispute not subject to, or where a party has opted out of, arbitration under Section 14) shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-laws principles. You agree that any such legal action or proceeding shall be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of such courts.
Entire Agreement. These Terms constitute the entire agreement between you and LG Roofing Materials regarding use of the Site and supersede any prior agreements between you and LG Roofing Materials relating to the Site.
Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
Assignment. You may not assign or transfer these Terms without our prior written consent. LG Roofing Materials may assign these Terms, in whole or in part, at any time without notice.
Force Majeure. LG Roofing Materials is not liable for any failure or delay resulting from causes beyond our reasonable control, including acts of God, natural disaster, war, terrorism, civil unrest, labor conditions, or internet or utility service failures.
We may revise these Terms at any time by updating this page and the "Last updated" date above. Continued use of the Site after any such changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
